The terms  user, customer, member, subscriber, you and your are used interchangeably throughout this agreement to include anyone who has joined Free or paid money to utilize the services provided by TOIL. 

This agreement describes the terms and conditions applicable to your use of our resources and services and the general principles of SBW, Inc. If you do not agree to be bound by the terms and conditions of this Agreement, do not use or access our web-site, resources, or services.

You must read, agree with, accept and abide by all of the terms and conditions contained in these User Terms, which include those terms and conditions expressly set out below, those incorporated by reference and those contained on the content pages of the web site itself if you become and remain a member of TOIL.

By clicking on any secure or non-secure server link or by calling a form action in any other way - You agree to these User Terms. 

If any of the provisions of this Agreement are determined by a court to be unenforceable, they shall be severed from this Agreement, and the remaining provisions shall remain in full force and effect.

We may amend this Agreement at any time by posting the amended terms on the site. Except as stated below, all amended terms shall automatically be effective as soon as they are initially posted on the site.

Services: You may use TOIL to email appropriate marketing offers to those in your downline (but not more than once a week). You agree to receive one email from seven people in your upline each week. If you no longer wish to receive these emails, you agree to log in and delete your account.

Every effort has been made to accurately represent the Pro Membership of TOIL and its' potential. Even though this industry is one of the few where one can write their own check in terms of earnings, there is no guarantee that you will earn any money using this site or it's services. Earning potential is entirely dependent on the person using the services available on TOIL.

NO SPAM Policy:

We have a zero tolerance SPAM Policy. SPAM shall include, but not be limited to, the sending of unsolicited information to a person or group that has not specifically asked to receive that particular information or is not a personal acquaintance of the individual sending the information. 

Any TOIL user that engages in SPAM in connection with the site in any way may have their membership terminated immediately and may be held liable for any and all damages or losses caused by their actions.

SBW, Inc. reserves the right to issue revisions to these Terms of Use by publishing a revised version of this document on this site: that version will then apply to all use by you following the date of publication. Each access of information from TOIL will be a separate, discrete transaction based on the then prevailing terms. 

This Terms of Use and the license granted may not be assigned or sublet by You without SBW, Inc.'s written consent in advance. 

These Terms of Use shall be governed by, construed and enforced in accordance with the laws of the State of Oklahoma, as it is applied to agreements entered into and to be performed entirely within such jurisdiction.

To the extent you have in any manner violated these terms or threatened to violate SBW, Inc.'s  intellectual property rights, SBW, Inc. may seek injunctive or other appropriate relief in any state or federal court in the State of Oklahoma, and you consent to exclusive jurisdiction and venue in such courts.

Any other disputes will be resolved as follows:

If a dispute arises under this agreement, we agree to first try to resolve it with the help of a mutually agreed-upon mediator in Cleveland County, Oklahoma. Any costs and fees other than attorney fees associated with the mediation will be shared equally by each of us.

If it proves impossible to arrive at a mutually satisfactory solution through mediation, we agree to submit the dispute to binding arbitration in Cleveland County, Oklahoma  under the rules of the American Arbitration Association. Judgment upon the award rendered by the arbitration may be entered in any court with jurisdiction to do so. 

If any provision of this agreement is void or unenforceable in whole or in part, the remaining provisions of this Agreement shall not be affected thereby.

Termination:

These Terms of Use agreement are effective until terminated by either party. You may terminate your Free or Pro membership at any time by deleting your account. If you have a Pro Membership, you will also need to cancel your PayPal subscription. Likewise, your Free and/or Pro membership may be terminated immediately without notice by SBW, Inc. at the sole discretion of SBW, Inc. In such cases, SBW, Inc. will delete your account and/or cancel your PayPal subscription.
